Terms of Service

msgbubbles gives businesses a dedicated line for sending and receiving iMessage and SMS messages, a shared inbox to manage conversations, and an API and webhooks to automate them. We may change, add, or remove features over time.

You must provide accurate information when you create an account and keep it up to date. You are responsible for activity under your account, for keeping your API keys secret, and for the actions of anyone you invite to your workspace. Tell us right away at hello@msgbubbles.com if you believe your account or keys have been compromised.

You are responsible for the messages you send through the Services. You agree to:

• Obtain and keep records of any consent required by law, such as the Telephone Consumer Protection Act (TCPA) and CAN-SPAM, before messaging a recipient.
• Honor opt-out requests promptly, including replies of STOP, and never message a recipient who has opted out unless they opt back in.
• Follow carrier requirements and industry guidelines, including the CTIA Messaging Principles and Best Practices, and any registration requirements such as 10DLC.
• Identify your business clearly in your messages.

You may not use the Services to:

• Send spam, unsolicited bulk messages, or messages to purchased or rented lists.
• Send content that is illegal, fraudulent, deceptive, harassing, hateful, or sexually explicit.
• Send content related to prohibited or restricted categories under carrier rules, such as illegal drugs, high-risk financial services, or phishing.
• Impersonate any person or business, or misrepresent who a message is from.
• Interfere with, probe, or overload the Services, or attempt to bypass rate limits or security controls.

We may review, filter, or block messages, and suspend or terminate accounts, that we reasonably believe violate these Terms or put the Services, carriers, or recipients at risk.

These terms apply when you receive text messages from msgbubbles itself, such as account verification codes, service notifications, and support conversations.

• Opting in. You agree to receive these messages when you provide your phone number to us and choose to receive texts, or when you text us first.
• Message frequency varies based on your account activity and requests.
• Message and data rates may apply. Check with your mobile carrier for details.
• Opting out. Reply STOP at any time to stop receiving messages. You will receive one final message confirming your opt-out.
• Help. Reply HELP for help, or email hello@msgbubbles.com.
• Carriers are not liable for delayed or undelivered messages.

Businesses that use msgbubbles to text you run their own messaging programs. Their terms and privacy policies govern those messages, and replying STOP to their number opts you out of messages from that business.

Paid plans are billed as described at signup or in your order. Fees are non-refundable except where required by law. Carrier pass-through fees and taxes may be added. We may change our pricing with advance notice.

You keep ownership of the messages, contacts, and other content you submit to the Services. You grant us a limited license to host, process, and transmit that content only as needed to provide and secure the Services. Our use of personal information is described in our Privacy Policy.

Message delivery depends on third parties such as Apple, mobile carriers, and messaging partners. We are not responsible for their availability, and they may filter, delay, or block messages. iMessage is a trademark of Apple Inc., which is not affiliated with and does not endorse msgbubbles.

You can stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or if required by a carrier or by law. Sections that by their nature should survive termination will survive.

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any message will be delivered or delivered on time.

To the fullest extent permitted by law, msgbubbles will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the claim arose.

You will defend and indemnify msgbubbles against claims, fines, and costs arising from your content, the messages you send, or your violation of these Terms or applicable law.

We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, provide additional notice. Continuing to use the Services after changes take effect means you accept the updated Terms.
